SUBJECT: Discussion Paper – Summary Judgment

The Federal Court of Appeal and Federal Court’s Rules Committee directed a subcommittee to look into the question of summary judgments.

The subcommittee – composed of the Honourable Gilles Létourneau of the Federal Court of Appeal, the Honourable Johanne Gauthier of the Federal Court, Professor W.A. Bogart, Law Faculty, University of Windsor, Professor Denis Ferland, Law Faculty, Laval University, Professor Janet Walker of Osgoode Hall Law School and Mr. John Morrissey of Smart & Biggar – has prepared a working paper on the question. It is circulated for the purpose of receiving comments on possible alternatives to the present Rule 216.

The Subcommittee will report to the Rules Committee following receipt of comments and, where appropriate, will recommend measures concerning the issue under discussion.
